Why the Filing Period Restarted

Ohio requires continuous SR-22 filing for 3 years for most triggering offenses. The 3-year clock measures uninterrupted coverage. When your policy lapsed, the filing lapsed with it. The carrier sent an SR-26 cancellation notice to the BMV, which legally terminated your proof of financial responsibility.

When you file SR-22 again, the BMV starts a new 3-year period from that filing date. Any time already served under the original filing does not carry forward. If you were 18 months into a 3-year requirement when the lapse occurred, you lost those 18 months. The new filing runs 3 full years from the date the carrier submits it.

The BMV does not prorate or credit partial compliance. Ohio treats the lapse as a break in the filing obligation, which voids prior progress and resets the entire requirement.

How to File SR-22 After the Lapse

You need a carrier willing to write Ohio SR-22 coverage immediately and file electronically with the BMV. Not all carriers write post-lapse SR-22, and processing speed varies.

Contact a carrier that writes non-standard Ohio SR-22 policies. Carriers confirmed to write SR-22 in Ohio after lapse or violation include Acceptance Insurance, Bristol West, Dairyland, Direct Auto, GAINSCO, Geico, The General, National General, Progressive, and State Farm. Most offer same-day or next-business-day electronic filing to the BMV once the policy binds. The carrier files the SR-22 form as proof of financial responsibility; you do not file it yourself.

Purchase the minimum liability coverage Ohio law requires: $25,000 bodily injury per person, $50,000 bodily injury per accident, $25,000 property damage. The carrier adds the SR-22 endorsement to the policy and submits it electronically to the BMV. Expect a small one-time filing fee set by the carrier and state. The policy must remain active without lapse for the full 3-year filing period or the cycle restarts again.

Clearing Both Suspensions

After the carrier files SR-22, the BMV receives electronic confirmation and marks the lapse suspension eligible for reinstatement. You still owe the $40 reinstatement fee for the lapse suspension. The original suspension (OVI, prior insurance violation, or other triggering offense) remains active and requires its own separate $40 reinstatement fee.

If the original suspension also had other requirements (Driver Intervention Program for OVI, proof of payment for FRA suspensions, court compliance for judicial suspensions), those requirements remain in force and must be satisfied before the BMV will accept the reinstatement fee for that suspension. The lapse suspension clears independently once you pay its $40 fee and maintain active SR-22 filing.

Both reinstatement fees can be paid together at the BMV, but each suspension clears separately. Driving privileges do not restore until both suspensions are fully cleared and all required fees are paid.

What Happens If You Lapse Again

The SR-22 filing period resets with each lapse, extending the total time you remain under filing obligation indefinitely if lapses continue.
